PUBLIC PATH DIVERSION ORDER, TOWN AND COUNTRY PLANNING ACT 1990, SECTION 257.

CENTRAL BEDFORDSHIRE COUNCIL (HARLINGTON: PART OF FOOTPATH NO. 2)

PUBLIC PATH DIVERSIONORDER 2025.

This order is made by Central Bedforshire Council under section 257 of the Town and Country planning Act 1990 because it is satisfied that it is necessary to divert the footpath to which this order relates in order to enable development to be carried out in accordance with planning permission granted under part 3 of the Town and Country Planning Act 1990, namely:tyhe construction of 400 dwellings and land for a primary school, open space and associated infrastucture ( Planning application references CB/21/05416/OUT and CB//23/01360/RM for phase 1 and CB/24/01455/RM for phase 2)

BY THIS ORDER:

  1. The footpath over the land shown by bold continuous black line between A-B on attached map and descibed in part 1 of the schedule to this order (“The schedule”) shall be provided below.
  2. There shall br created to the reasonable satisfaction of Central Bedfordshire Council an alternative highway for use as a replacement for the said footpath as provided in part 2 of the schedule and shown by bold black dashes between points A-C-D-E-F-G-H-I-B on the attached map.
  3. The stopping up of the footpath and creation of an alternative highway shall have effect on the date on which Central Bedfordshire Council certify that the terms of Article 2 above have been complied with.
  4. The following works shall be carried out in relation to the highway descibed in part 2 of the schedule:i The laying out of the new section of bridleway No. 36 Harlington between points A-C-D-E-F-G-H-I-B on the order map with either a tarmac or bound surface of width 3 metres with a rolled grass strip of 1 metre.
